WinnerSelect Terms of Service

Last updated: September 2026

These Terms of Service (“Terms”) govern access to and use of WinnerSelect, including the WinnerSelect website, winner selection tools, draw functionality, reports and associated services (together, the “Service”).

WinnerSelect is operated by UKCPSA Limited, a company registered in England and Wales under company number 16797263, whose registered office is at 3rd Floor, 86–90 Paul Street, London, United Kingdom, EC2A 4NE (“UKCPSA”, “WinnerSelect”, “we”, “us” or “our”).

By creating an account, purchasing a subscription, accessing or using the Service, you confirm that you are acting for business or professional purposes and agree to be bound by these Terms.

If you use WinnerSelect on behalf of a company, organisation, agency or other entity, you confirm that you have authority to bind that entity to these Terms.

1. Business users only

WinnerSelect is provided as a business-to-business service.

It is intended for businesses, competition operators, marketing agencies, charities and other organisations requiring tools to select winners or make random selections.

The Service is not intended to be purchased by consumers for personal, family or household purposes.

2. What WinnerSelect provides

WinnerSelect provides software tools that enable customers to upload or enter eligible entries, ticket numbers and associated entrant names and use the Service to make a random selection from the submitted pool.

Depending on the customer's subscription and the functionality available at the time, the Service may also provide draw records, audit information, reports, branding options, previous draw information and other associated functionality.

WinnerSelect provides the technology used to conduct a selection.

WinnerSelect does not organise, operate, supervise, approve, certify or adjudicate the customer's competition, prize draw, promotion or other activity.

Use of WinnerSelect does not mean that a competition or promotion has been approved, endorsed or certified by UKCPSA Limited.

3. Customer responsibility for competitions

The customer remains solely responsible for the competition, prize draw, promotion or other activity for which WinnerSelect is used.

This includes responsibility for:

  • ensuring that the competition or promotion is lawful;
  • complying with all applicable legislation, regulation, codes and guidance;
  • creating and complying with the customer's own competition terms and conditions;
  • determining which entries and entrants are eligible;
  • ensuring that any required free-entry route or other entry mechanism is properly administered;
  • ensuring that all valid entries which should participate in a draw are included;
  • removing entries which are invalid, duplicated, refunded, cancelled, disqualified or otherwise ineligible where appropriate;
  • ensuring that the information supplied to WinnerSelect is complete and accurate;
  • selecting the appropriate draw settings and method;
  • confirming that the correct file, dataset or entry pool has been submitted;
  • verifying the result before publicly announcing a winner or awarding a prize; and
  • resolving any dispute between the customer and its entrants, participants or winners.

WinnerSelect does not independently verify the accuracy, completeness, eligibility or legality of entries supplied by a customer.

4. Check before you draw

The customer must take reasonable steps to verify the accuracy and completeness of the draw pool before conducting a live or final draw.

The customer must not rely on WinnerSelect to identify missing, incorrect, duplicated, invalid or otherwise inappropriate entries unless a particular feature of the Service expressly states that it performs that function.

Once a draw has been conducted, the customer must review the result and relevant draw information before announcing the result publicly or awarding a prize.

If the customer believes that a draw, dataset or result may contain an error, the customer must not announce or act upon the result until the issue has been investigated.

5. Uploaded data

WinnerSelect is designed to process only the information reasonably required to perform winner selection.

Customers should normally upload only:

  • entrant or participant names; and
  • ticket, entry or other relevant identifying numbers.

Customers must not upload unnecessary personal information, including email addresses, postal addresses, telephone numbers, payment or banking information, passwords, identity documents, health information, special-category personal data or other sensitive information.

The customer is responsible for ensuring that it has a lawful basis and all necessary notices, permissions or other authority to process and upload any personal data submitted to WinnerSelect.

Where WinnerSelect processes entrant information on behalf of a customer, the data-processing provisions in section 18 of these Terms apply.

6. Accounts and security

Customers are responsible for maintaining the confidentiality and security of their account credentials.

Accounts must not be shared with unauthorised persons.

The customer is responsible for activity carried out through its account by persons it has authorised to use the Service.

The customer must notify WinnerSelect promptly if it becomes aware of unauthorised access to its account.

We may require password resets or take other reasonable security measures where we believe an account or the Service may have been compromised.

7. Acceptable use

Customers must not:

  • use WinnerSelect for unlawful, fraudulent or deceptive purposes;
  • knowingly upload false, malicious or unlawfully obtained information;
  • attempt to manipulate or interfere with the selection process;
  • attempt to circumvent usage limits or subscription restrictions;
  • represent a test draw as an independently verified or official WinnerSelect draw where this is misleading;
  • attempt to access another customer's account or information;
  • introduce malware, malicious code or other harmful material;
  • probe, scan or test the vulnerability of the Service without written permission;
  • reverse engineer, decompile or attempt to derive the source code of the Service except to the extent that such restriction is prohibited by law;
  • copy, reproduce, resell or commercially exploit the Service except as expressly permitted by us; or
  • use the Service in a manner that could damage, disable, overload or materially impair WinnerSelect or its infrastructure.

We may suspend or terminate access where we reasonably believe these Terms have been breached or the security, integrity or availability of the Service is threatened.

8. Draw results and randomness

WinnerSelect is designed to make selections using the random-selection mechanisms implemented within the Service.

A correctly generated result is based on the pool and instructions supplied to the Service at the time the draw is conducted.

WinnerSelect cannot compensate for incorrect, incomplete or ineligible data supplied by the customer.

The fact that a particular entrant wins, does not win, wins more than once, or that a result appears statistically unusual does not of itself indicate that the Service has malfunctioned. Random processes can produce outcomes that appear unusual or repetitive.

Customers must not rerun a valid draw merely because they dislike or did not expect the result, except where their own competition rules legitimately require a redraw.

9. Draw records and reports

WinnerSelect may generate draw records, audit information, certificates, integrity reports or other records relating to use of the Service.

Such records document information available to WinnerSelect and events recorded by the Service.

They do not constitute:

  • legal advice;
  • regulatory approval;
  • certification that the customer's competition is lawful;
  • confirmation that every eligible entry was supplied by the customer;
  • confirmation that the customer's competition terms have been followed; or
  • a guarantee against a dispute or regulatory investigation.

10. Availability of the Service

We aim to provide a reliable and professional Service, but no internet-based software service can be guaranteed to operate without interruption.

WinnerSelect is therefore provided subject to reasonable periods of:

  • maintenance;
  • updates and upgrades;
  • technical faults;
  • emergency maintenance;
  • internet or network failures;
  • hosting or infrastructure failures;
  • failures affecting third-party suppliers; and
  • circumstances outside our reasonable control.

We do not warrant that the Service will always be available, uninterrupted, completely secure or entirely error-free.

Where reasonably practicable, we will seek to restore material service failures promptly.

Customers should not structure a time-critical competition in a manner that leaves no reasonable contingency if an online service becomes temporarily unavailable.

11. Changes to the Service

WinnerSelect is an evolving software product.

We may add, modify, replace or discontinue features where reasonably necessary to improve the Service, maintain security, respond to legal or technical requirements or develop the product.

We will not intentionally remove the fundamental functionality of a paid subscription during its current billing period without reasonable justification.

12. Subscriptions and payment

Access to some or all WinnerSelect functionality requires a paid subscription or other paid plan.

Prices, usage allowances and features applicable to each plan are displayed when the customer subscribes.

Unless stated otherwise, subscriptions renew automatically for the applicable billing period until cancelled.

Payments may be processed by third-party payment providers. WinnerSelect does not ordinarily store full payment-card details.

The customer is responsible for applicable taxes and for keeping its billing information current.

We may suspend paid functionality where payment is overdue or unsuccessful.

13. Usage allowances

Some plans may include a specified number of draws, selections, users or other usage allowances during a billing period.

Unused allowances do not carry forward unless expressly stated otherwise.

Customers must not attempt to circumvent usage limits by creating duplicate accounts, manipulating draw records or otherwise abusing the Service.

14. Cancellation

Customers may cancel their subscription in accordance with the cancellation functionality made available through WinnerSelect or its payment provider.

Cancellation prevents future renewal but does not normally result in a refund for a billing period that has already commenced.

The customer will normally retain access to paid functionality until the end of the period already paid for, unless the account has been terminated or suspended for breach of these Terms.

Nothing in this section affects any rights which cannot lawfully be excluded.

15. Intellectual property

WinnerSelect, its software, interface, branding, design, databases, documentation and underlying technology are owned by or licensed to UKCPSA Limited and are protected by applicable intellectual-property laws.

The customer receives a limited, non-exclusive, non-transferable right to use the Service for its internal business purposes for the duration of its account or subscription.

The customer retains ownership of information and branding that it uploads to WinnerSelect.

The customer grants us the limited rights necessary to host, process, reproduce and display that information solely for providing and operating the Service.

16. No legal or regulatory advice

Information provided through WinnerSelect, UKCPSA or associated materials may assist customers in understanding good practice, but use of the Service does not constitute legal advice.

Customers remain responsible for obtaining their own professional advice where necessary and for ensuring that their competitions comply with applicable law and regulatory requirements.

No statement made by WinnerSelect should be interpreted as guaranteeing that a particular competition, promotion or business model is lawful.

17. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided on an “as available” basis.

We do not warrant or guarantee:

  • uninterrupted availability;
  • that the Service will be completely free from defects or errors;
  • that every customer error will be detected;
  • that customer-supplied data is correct;
  • any particular commercial result;
  • increased sales, revenue or participation;
  • that use of WinnerSelect will prevent complaints or disputes; or
  • regulatory approval of a customer's competition.

Nothing in these Terms limits obligations or warranties which cannot lawfully be excluded.

18. Data processing terms

Where a customer uploads personal data relating to entrants or participants for WinnerSelect to process on the customer's behalf, the customer acts as controller and UKCPSA Limited acts as processor, to the extent those roles apply under applicable data-protection law.

18.1 Processing instructions

WinnerSelect will process such personal data only:

  • to provide the Service;
  • in accordance with these Terms and the customer's documented instructions;
  • as reasonably necessary to maintain the security and integrity of the Service; or
  • where required by applicable law.

The customer's use and configuration of the Service constitutes documented instructions for the relevant processing.

18.2 Nature and purpose

The subject matter and purpose of the processing is the temporary receipt, storage, organisation and use of entrant information for winner selection, associated draw records and functionality requested by the customer.

The duration of processing is the period for which the information is required to provide the Service, subject to WinnerSelect's applicable retention and deletion arrangements.

Data subjects will normally be entrants or participants in the customer's competition or promotion.

Personal data should ordinarily be limited to names and ticket, entry or identifying numbers.

18.3 Confidentiality and security

WinnerSelect will ensure that persons authorised to process customer personal data are subject to appropriate confidentiality obligations.

WinnerSelect will implement appropriate technical and organisational measures designed to protect personal data against unauthorised or unlawful processing and against accidental loss, destruction, alteration or disclosure.

18.4 Sub-processors

The customer provides general authorisation for WinnerSelect to use reputable third-party service providers where reasonably necessary to host, secure, maintain or provide the Service.

WinnerSelect will impose appropriate data-protection obligations on subprocessors as required by applicable data-protection law.

Where required by law, WinnerSelect will provide reasonable notice of material changes to subprocessors and allow customers an opportunity to raise legitimate data-protection objections.

18.5 Assistance

Taking into account the nature of the processing and information available to us, WinnerSelect will provide reasonable assistance to customers in relation to:

  • requests by data subjects exercising their data-protection rights;
  • security obligations;
  • qualifying personal-data breaches;
  • data-protection impact assessments; and
  • regulatory consultation where legally required.

18.6 Personal-data breaches

If WinnerSelect becomes aware of a personal-data breach affecting personal data processed on behalf of a customer, we will notify the affected customer without undue delay where required by applicable law and provide reasonably available information to assist the customer in meeting its obligations.

18.7 Deletion and return

At the end of the relevant processing, WinnerSelect will delete or return personal data in accordance with the customer's instructions and our documented retention arrangements, unless applicable law requires continued storage.

Information contained in backups may remain securely stored until overwritten or deleted through the normal backup cycle, provided it is not restored to active use except where reasonably necessary for disaster recovery, security or legal purposes.

18.8 Compliance information and audits

WinnerSelect will make available information reasonably necessary to demonstrate compliance with applicable processor obligations.

Where an audit is legally required, it must be conducted on reasonable prior notice, during normal business hours, in a manner that does not compromise the security or confidentiality of other customers or materially disrupt the Service.

Where appropriate, independent security documentation, certifications, reports or other compliance information may be supplied in place of an on-site inspection.

The customer will bear its reasonable costs of an audit unless the audit identifies a material breach by WinnerSelect of its applicable data-processing obligations.

19. Customer indemnity

To the extent permitted by law, the customer will indemnify UKCPSA Limited against third-party claims, losses, liabilities, damages and reasonable costs arising from:

  • the customer's unlawful operation of a competition or promotion;
  • the customer's breach of its own competition terms;
  • information uploaded or supplied by the customer without appropriate authority;
  • infringement of a third party's intellectual-property or data-protection rights by material supplied by the customer;
  • fraudulent, malicious or unlawful use of WinnerSelect by the customer; or
  • a material breach by the customer of these Terms.

This indemnity does not apply to the extent that the relevant loss was caused by UKCPSA Limited's own breach of these Terms or applicable law.

20. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

Subject to the paragraph above, UKCPSA Limited will not be liable for:

  • loss of profits;
  • loss of revenue;
  • loss of business;
  • loss of anticipated savings;
  • loss of opportunity;
  • loss of goodwill or reputation;
  • business interruption;
  • loss or corruption of data where the customer was responsible for maintaining an appropriate copy or backup;
  • the value or cost of any prize;
  • refunds, compensation or goodwill payments made by the customer to its entrants or customers;
  • advertising or marketing expenditure associated with a competition;
  • losses caused by incorrect, incomplete, duplicated, corrupted or ineligible data supplied by the customer;
  • losses caused by the customer's failure to verify a draw pool or result;
  • losses resulting from the customer's competition rules or failure to comply with them; or
  • any indirect or consequential loss.

UKCPSA Limited will not be liable for failure or delay caused by events outside its reasonable control, including internet or telecommunications failures, third-party infrastructure failures, hosting outages, cyberattacks despite reasonable protective measures, power failures, governmental action or other events beyond our reasonable control.

Subject to liabilities which cannot lawfully be limited, UKCPSA Limited's total aggregate liability arising out of or in connection with the Service, these Terms or a customer's use of WinnerSelect will not exceed the total fees actually paid by that customer to UKCPSA Limited for WinnerSelect during the 12 months immediately preceding the event giving rise to the claim.

Where the customer has used WinnerSelect for less than 12 months, the cap will be the total WinnerSelect fees actually paid by that customer during that shorter period.

The parties acknowledge that the pricing of WinnerSelect reflects this allocation of risk.

21. Customer responsibility to mitigate loss

If a customer becomes aware of a suspected error, malfunction or other issue affecting a draw, the customer must take reasonable steps to prevent or minimise resulting loss.

This includes delaying announcement of a result or award of a prize where there is a reasonable basis to believe that the draw may have been affected by an error.

WinnerSelect will not be responsible for avoidable losses that arise because the customer continued to rely on a result after becoming aware, or when it reasonably should have become aware, of a material issue.

22. Suspension and termination

We may suspend or terminate access to WinnerSelect where:

  • the customer materially breaches these Terms;
  • payment remains overdue;
  • use of the account presents a security risk;
  • we reasonably suspect fraud or deliberate manipulation;
  • continued provision would breach applicable law; or
  • the customer uses WinnerSelect in a manner likely to cause material harm to us, the

Service or another user.

Where reasonably practicable, we will give the customer an opportunity to remedy a remediable breach before termination.

23. Changes to these Terms

We may update these Terms from time to time to reflect changes to the Service, applicable law, security requirements or our business operations.

Where a change materially affects existing customers' rights or obligations, we will take reasonable steps to notify affected customers before the change takes effect.

The current version will always be made available through the WinnerSelect website.

24. Notices

Notices and communications relating to the Service may be provided electronically, including by email or through the customer's WinnerSelect account.

Customers are responsible for keeping their account contact information current.

25. Entire agreement

These Terms, together with any applicable order, subscription information and documents expressly incorporated into them, constitute the agreement between UKCPSA Limited and the customer concerning WinnerSelect.

They supersede previous discussions or representations relating to the Service, except in the case of fraud or fraudulent misrepresentation.

26. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

Where possible, an invalid or unenforceable provision will be interpreted or modified only to the minimum extent necessary to make it valid and enforceable.

27. No waiver

Failure by either party to enforce a right under these Terms does not waive that right.

28. Assignment

The customer may not transfer its rights or obligations under these Terms without our prior written consent.

UKCPSA Limited may transfer these Terms as part of a merger, restructuring, sale of business or transfer of WinnerSelect, provided that doing so does not materially reduce the customer's contractual rights.

29. Third-party rights

Unless expressly stated otherwise, no person other than the customer and UKCPSA Limited has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.

30. Governing law and jurisdiction

These Terms and any dispute or claim arising from them or from use of WinnerSelect are governed by the laws of England and Wales.

The courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising from or relating to these Terms or the Service.
